AI Funnel Marketing – Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the AI Funnel Marketing services, websites, applications, tools, and related offerings (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility

• 18+ Requirement: You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are 18 or older.
• Geographic Eligibility: The Service is offered only to residents of the United States and Canada. You may not use the Service if you reside outside these regions. By using the Service, you represent and warrant that you are a resident of the United States or Canada.
• Account Responsibility: You agree to use the Service in compliance with these Terms and all applicable laws.

2. Description of the Service

AI Funnel Marketing provides AI‑powered marketing content creation tools and related services, including but not limited to:

• Lead generation tools, landing pages, and funnel creation features
• AI‑generated images, videos, text ads, social posts, and other marketing assets
• Tools that allow users to publish content to their own personal or business social media profiles (e.g., posting to a Facebook wall or business page)
• Marketing templates, automation tools, and strategy resources to support user‑driven marketing efforts

AI Funnel Marketing does not create, manage, optimize, or run paid advertising campaigns, does not access or manage advertising accounts, and does not place or control ad spend on any platform. All paid advertising activities are solely the responsibility of the user.

Specific services may be defined in separate agreements or order forms. If a conflict exists, the more specific written agreement controls.

3. Accounts and Access

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must notify us immediately of unauthorized access at contact@aifunnelmarketing.com.

4. AI‑Generated Content and Usage

The Service may allow you to generate AI‑powered content, including images, videos, text ads, and other digital assets. You understand and agree that:

• Generated content is considered “used” whether or not you download it.
• We cannot revoke or delete AI‑generated assets once created.
• You are responsible for how you use any generated content.

5. Fees, Billing, and Refund Policy

5.1 Membership Fees

You agree to pay all applicable membership fees (monthly or yearly) associated with your plan.

5.2 Refund Policy (30‑Day Guarantee)

Membership fees (monthly or yearly) are eligible for a refund within 30 days of the original payment date, subject to the following:

• 100% refund if no AI‑generated content has been created.
• Up to 25% usage fee will be deducted if you generated any AI content (images, videos, text ads, or other assets), to cover compute and creation costs.
• After 30 days, no refunds are issued for any reason.

5.3 Non‑Refundable Items

The following are non‑refundable at all times:

• Credits
• AI bundle packages
• Add‑ons, upgrades, or premium features
• Any digital goods or consumable AI resources
• Ad spend (if applicable)

5.4 Cancellation

You may cancel at any time. Cancellation stops future billing but does not entitle you to refunds outside the 30‑day policy.

6. No Guarantee of Results

Marketing, advertising, and AI‑generated content inherently involve uncertainty. You acknowledge that we do not guarantee:

• Any number of leads
• Any level of performance
• Any revenue, profit, or business outcome
• Any specific results from AI‑generated content

7. Prohibited Uses

You agree not to use the Service for:

• Illegal or harmful activities
• Spam or unsolicited messages
• Fraudulent or deceptive practices
• Abusive, harassing, or harmful behavior
• Infringing on intellectual property or privacy rights

8. Accessibility

Members are responsible for ensuring their content complies with all applicable accessibility laws including closed captioning requirements. AI Funnel Marketing, its officers, employees, agents, or owners cannot be held responsible for any content that is not fully accessible to the public.

9. Intellectual Property

• Our IP: All platform tools, software, and systems remain our property.
• Your IP: You retain ownership of your uploaded content. You grant us a license to use it solely to provide the Service.

10. Confidentiality

Both parties agree to keep non‑public information confidential unless required by law.

11. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind.

12. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages.
• Our total liability is limited to the fees you paid in the 3 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless AI Funnel Marketing from claims arising out of your use of the Service.

14. Mediation, Arbitration, and Dispute Resolution

14.1 Mandatory Mediation

Before filing any lawsuit or arbitration, you must participate in mandatory mediation in Mecklenburg County, North Carolina.

The initiating party (plaintiff) must pay all mediation fees.

14.2 Binding Arbitration

If mediation fails, disputes must be resolved through binding arbitration in Mecklenburg County, NC.

14.3 No Class Actions

You agree to resolve disputes only on an individual basis. You waive any right to:

• Class actions
• Collective actions
• Representative actions

14.4 Governing Law

These Terms are governed by the laws of the State of North Carolina.

15. Modifications

We may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.

16. Termination

We may suspend or terminate your access for violations of these Terms or harmful behavior.
